Please carefully review the following terms and conditions. By completing our Order Inspection form, you are indicating your agreement to abide by these terms and conditions. The rights and obligations outlined in your agreement with VECCRAM are personal to you and cannot be transferred to another party. If you placed your order by phone, you have a two-hour window to review these terms and notify VECCRAM by phone or email if you do not agree. Making a purchase online or by phone signifies your acceptance of the terms of this agreement.

Nature of VECCRAM Vehicle Inspection Services: When you engage VECCRAM for inspection services, you are commissioning us to assess the overall condition of the designated vehicle based on what our inspectors can visually observe. Our inspectors do not utilize hoists or tools (for vehicles manufactured after 1996, the OBD2 computer may be utilized), nor do they dismantle vehicles. Our service entails a visual inspection of all reasonably accessible components only, and certain issues may not be detectable during the inspection. While our inspectors will endeavor to conduct a test drive of the vehicle, if this is not feasible, a test drive will not be performed. Upon completion of the inspection, you will receive a hyperlink to the inspector's report, accompanied by a package of photographs of the vehicle.

VECCRAM Vehicle Inspection Services Limited to Inspections and Appraisals: VECCRAM exclusively provides inspection and appraisal services. We are not associated with the seller of the vehicle and do not offer an opinion on whether you should or should not proceed with the purchase. VECCRAM does not verify the seller's legal right to sell the vehicle, nor are we liable for any representations made by the seller or any other party.

Vehicle Remains "As Is": Given that the vehicle under inspection is considered "used," you acknowledge that, even following inspection, you will be acquiring the vehicle in its "as is" condition unless otherwise warranted by the seller. As a vehicle's condition may change between the time of inspection and the actual purchase, we recommend scheduling the inspection as close to the purchase date as feasible. Please note that the VECCRAM report does not serve as a substitute for any safety and/or emissions inspections mandated by applicable state laws. Our inspection does not constitute a warranty on the vehicle's condition, nor does VECCRAM or its services extend or affirm any warranties provided by the seller.

Factors Affecting Inspections VECCRAM Vehicle Inspection Services: Our inspections may be impacted by weather and lighting conditions, as well as the cleanliness of the vehicle, both internally and externally, at the time of the inspection. Various external factors, beyond our control, can diminish the accuracy of the inspection, making it challenging to detect details such as repainting and bodywork with the naked eye. For the most precise inspection report, the vehicle should be clean, dry, and positioned in a well-lit area during the inspection. However, VECCRAM does not undertake any actions that affect the vehicle's condition at the time of inspection. We strongly recommend that you communicate with the seller and ensure all necessary arrangements are made to ensure the vehicle is as clean as possible and available in a suitable location for inspection.

Resolution of Disputes:

(i) Right to Cure: Before initiating any legal action against VECCRAM as outlined below, you agree to provide us with written notice [refer to paragraph 12] outlining your concerns about our services and grant us at least thirty (30) calendar days to address the issue.

(ii) Mediation: After the expiration of the cure period mentioned above, you agree to attempt to resolve any disputes with VECCRAM through non-binding mediation. Mediation will take place at a location selected by VECCRAM in Carlyle, Illinois. No other legal or administrative proceedings between you and VECCRAM shall be initiated without first attempting to resolve the disputes through mediation. Each party shall bear their respective costs and expenses associated with mediation. Failure to mediate any dispute prior to pursuing other legal or administrative proceedings will be considered as your acknowledgment of waiving your claim(s) against VECCRAM.

(iii) Litigation, Applicable Law, and Waivers: You agree that any action pertaining to this agreement or VECCRAM services shall be interpreted under the laws of the State of Illinois, and such action shall be filed and prosecuted in either the federal or state courts situated in Clinton County, Illinois. Both you and VECCRAM waive the right to request a change of venue. Additionally, both you and VECCRAM waive the right to a jury trial in any such litigation.

LIMITATION OF LIABILITY: As VECCRAM is neither the seller nor the manufacturer of the vehicle or its parts, and as a VECCRAM inspection does not replace a mechanical inspection of the vehicle using diagnostic equipment and tools, you acknowledge that VECCRAM's liability is restricted to refunding the fee paid for the VECCRAM inspection if you are dissatisfied with our service or if injuries occur due to an undisclosed defect in the vehicle.

Cancellation: Once your order is placed, all sales are considered final. VECCRAM reserves the right to decline the requested inspection. In such cases, your prepaid inspection fee will be promptly refunded. If the vehicle is sold before an inspector is dispatched, your order will be placed "on hold," and you will receive a credit for the amount paid, which can be applied to another inspection and does not expire. However, cancellation for a refund is not permitted.

Unforeseeable Circumstances: You agree that if VECCRAM is delayed or prevented from performing the inspection or report due to circumstances beyond its control, such as computer malfunctions, restrictive laws or regulations, labor disputes, or acts of God, VECCRAM is excused from further obligations. In such cases, VECCRAM shall refund the inspection fee to you.
